Volga man facing charges

BUCKHANNON — A Barbour County man is facing a felony and two misdemeanor charges in Upshur County after allegedly threatening to assault an Upshur County Sheriff’s Office Sergeant while being processed for DUI and marijuana possession.

Jeffrey Thomas Oldaker, 59, of Volga, is charged with one count of retaliation against a public official, a felony; one count of first offense DUI and one count of possession of marijuana, both misdemeanors.

According to the criminal complaint filed by Sgt. Tyler A. Gordon with the Upshur County Sheriff’s Office, on Dec. 5, Oldaker was being placed under arrest by Deputy D. Frazier for alleged DUI and possession of marijuana. Gordon arrived at the Upshur County Courthouse in Buckhannon to assist Frazier with processing Oldaker and operating the intoximeter.

After Gordon arrived, Oldaker allegedly became upset with Upshur County Sheriff J. Michael Coffman “for the reason of the originating traffic stop,” the complaint states. Gordon writes that he attempted to calm Oldaker down by saying that Oldaker had the “absolute right” to challenge the validity of the traffic stop during the court process.

Gordon writes that, “all of a sudden,” Oldaker allegedly became “extremely upset and aggressive” towards him. Oldaker then allegedly said “I’d like to rip his … head off, and I could do it too,” while standing up like “he intended to attack” Gordon.

Oldaker then allegedly said, “I’d like to stab him in the … head,” while holding a pen and “motioning in a way that imitated stabbing someone,” the complaint states. Oldaker allegedly continued to threaten Gordon with bodily harm, as well as threatening to assault Gordon if he ever saw Gordon out of uniform. Oldaker also allegedly stated, “I’m going to come after you,” to Gordon.
