28 indicted by Upshur grand jury
BUCKHANNON – A total of 28 individuals were indicted by an Upshur County grand jury Monday, on charges ranging from sexual abuse to child neglect.
Steven Dewayne Arbogast, 44, of Buckhannon, was indicted for willfully, unlawfully and maliciously setting fire on lands, a felony; assault during the commission of a felony, a felony; malicious assault, a felony; and causing bodily injury during an arson-related crime, a felony.
Kenya Mae Smith, 20, of Buckhannon, was indicted for sexual abuse in the first degree, a felony, three counts; distribution and display to minor of obscene matter, a felony; sexual abuse of a child by a parent, guardian or person in a position of trust, a felony, three counts; and parent, guardian or person in a position of trust allowing sexual abuse to be inflicted upon a child, a felony, three counts.
Xander Gage Rose, 18, of French Creek, was indicted for child neglect creating substantial risk of death or serious bodily injury, a felony; driving while in an impaired state with an unemancipated minor, a misdemeanor; driving while in an impaired state, a misdemeanor; and underage consumption of alcohol, a misdemeanor.
John Patterson Monfort, 25, of Buckhannon, was indicted for distribution and exhibiting of material depicting minors engaged in sexually explicit conduct, involving violence against a child, a felony; distribution and exhibiting of material depicting minors engaged in sexually explicit conduct, a felony; possession of child erotica, a misdemeanor; possession of a controlled substance, cocaine, a misdemeanor; and possession of a controlled substance, tramadol, a misdemeanor.
Joseph Michael Wagner, 43, of Buckhannon, was indicted for possession of a controlled narcotic substance with the intent to deliver, fentanyl in combination with xylazine, a felony; conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia Code, a felony; and driving while in an impaired state, a misdemeanor.
Caleb Micah Beckner, 34, of Buckhannon, was indicted for strangulation, a felony; and domestic battery, first offense, a misdemeanor.
Rebecca Dawn Glover, 42, of Buckhannon; Jacob Allen Nottingham, 35, of Buckhannon; and Kelly Harvey, 41, of Buckhannon, were indicted for transportation of a controlled substance into state, fentanyl, a felony; conspiracy to transport a controlled substance into state, a felony; possession of a controlled substance with intent to deliver, fentanyl, a felony; delivery of a controlled substance, fentanyl, a felony; and conspiracy to deliver a controlled substance, a felony.
Mack William Sites, 43, of Buckhannon, was indicted for stalking with protective order in effect, a felony; tampering with a vehicle, a misdemeanor; violation of an order of protection, first offense, a misdemeanor, two counts; and nonconsensual disclosure of private intimate image, a misdemeanor.
Michael Tyler Peters, 36, of Glenville, was indicted for delivery of a controlled narcotic substance, fentanyl, a felony.
Dominick Payne Williams, 20, of Buckhannon, was indicted for possession of a controlled substance with the intent to deliver, methamphetamine, a felony; possession of a controlled substance with the intent to deliver, amphetamine in combination with dextroamphetamine, a felony; carrying a deadly weapon without license or authorization by person under 21, a misdemeanor; prohibited person in possession of a concealed firearm, a felony; and prohibited person in possession of a firearm, a misdemeanor.
Dominick Payne Williams, 20, of Buckhannon, and John Joseph Jeffries Jr., 40, of Buckhannon, were indicted for delivery of a controlled substance, methamphetamine, a felony; conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia Code, a felony; intimidation of a witness, a felony; conspiracy, a felony; and malicious assault, a felony.
Kenneth Ray Johnson, 59, of Buckhannon, was indicted for fleeing in a vehicle while under the influence, a felony; driving while in an impaired state, a misdemeanor, two counts; and possession of a controlled substance, marijuana, a misdemeanor.
Douglas Clayton Stover, 39, of Huntington, was indicted for driving while in an impaired state and proximately causing serious bodily injury to another person, a felony; driving while in an impaired state and proximately causing bodily injury to another person, a misdemeanor; and driving while in an impaired state, a misdemeanor.
Travis Clyde Medina, 41, of Clarksburg, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony; receiving or transferring stolen goods, a felony; fleeing by means other than the use of a vehicle, a misdemeanor; and possession of a controlled substance, methamphetamine, a misdemeanor.
Harley David King, 47, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, three counts; fraudulent registration, a felony; and no insurance, a misdemeanor.
Dustin Lynn Phillips, 43, of Buckhannon, was indicted for delivery of a controlled substance, methamphetamine, a felony, two counts.
Hailee Nikkole Isenhart, 31, of Buckhannon, was indicted for delivery of a controlled narcotic substance, fentanyl, a felony, two counts.
James Anthony Perednas, 35, of Buckhannon, and Clarence Edward Huffman Jr., 58, of Buckhannon, were indicted for delivery of a controlled substance, methamphetamine, a felony, three counts; delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony; and conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia Code, a felony.
George Frederick Norris, 64, of Buckhannon, was indicted for possession of a controlled substance with the intent to deliver, methamphetamine, a felony.
Donald Edwin DeBarr, 36, of Buckhannon, and Jessica Mae Kiser, 33, of Buckhannon, were indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony; delivery of a controlled substance, methamphetamine, a felony; and conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia Code, a felony.
Jason Dewayne Browning, 50, of Buckhannon, was indicted for delivery of a controlled substance, methamphetamine, a felony; and delivery of a controlled narcotic substance, fentanyl, a felony.
Christopher Robert Taylor, 51, of Buckhannon, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony, two counts.
Willie Junior DeBarr Jr., 36, of Buckhannon, was indicted for delivery of a controlled narcotic substance, fentanyl in combination with xylazine, a felony.
Levi Douglas Reed, 29, of Buckhannon, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony.
An indictment is merely an accusation and all defendants are presumed innocent unless and until proven guilty.
