12 indicted by Barbour County grand jury

PHILIPPI – A total of 12 people were indicted by a Barbour County grand jury on Monday, for alleged crimes including attempted murder and arson.

The following indictments are public at this time and the remaining indictments are sealed within the court record, according to court officials.

Christopher Bolyard, 35, has been indicted on one count of attempted murder, use of a firearm during the commission of a felony and malicious assault.

According to the criminal complaint, last June, Barbour County Sheriff’s Office deputies found Justin White, who was laying face down on a garage floor in Moatsville “with a gunshot wound to the head.” When asked who shot him, White allegedly replied, “Chris Bolyard, he was drunk.”

Upon Bolyard entering the Sheriff’s Office, police located a Smith & Wesson .40 caliber semi-automatic handgun holstered on Bolyard’s left hip, the complaint states. The handgun had one round of unspent ammunition in the chamber, along with “six other unspent ammo.” At the scene of the crime, police located a spent shell casing of a .40 caliber pistol, matching the same type of ammunition found in Bolyard’s handgun.

Bolyard is currently being held at the Tygart Valley Regional Jail on a $500,000 cash-only bond.

Bricen Hunter Siron, 20, was indicted on the charge of first-degree arson.

Siron, who was a Warren District Volunteer Fire Department firefighter at the time of his arrest, allegedly burned down a two-story residential structure fire that took place early Saturday morning on the Buckhannon Road. The structure was a complete loss, with only fire debris remaining, according to the criminal complaint. The home had no utilities turned on and had been empty for six years.

Police said Siron allegedly confessed to setting the house on fire, telling investigators that he joined the Warren District VFD about a month prior, and that he hadn’t got to fight any fires yet and was “wanting some excitement.”

Roscoe Jackson Keener, 76, was indicted on five counts of sexual abuse by a guardian, three counts of first-degree sexual assault and 2 counts of first-degree sexual abuse.

Keener was arrested in September and is accused of sexually abusing a child for around five years.

Brandon Guy Tenney, 34, of Montrose, and Bethany Marie Fortney, 30, of Philippi, were each indicted on three counts of child abuse resulting in injury.

The pair were arrested in July, with Tenney accused of physical abuse of four children, including holding children off the ground by their throats as a punishment.

Fortney told officers she was aware of the incidents involving Tenney and the four children, the criminal complaint states.

Mikela Marie Mitchell, 41, was indicted on three counts of burglary and three counts of grand larceny.

In 2025, Mitchell was charged in Barbour, Randolph and Upshur counties, and accused of stealing jewelry from homes in which she had worked for a cleaning company.

Christian Lee Lyons, 47, of Ashford, in Boone County, was indicted on the charges of forgery, uttering and grand larceny.

Lyons was charged last year in both Barbour and Upshur counties after allegedly trying to cash fraudulent checks at several BC Banks in 2024.

Alonzo Thompson, 63, of Port Chester, New York, has been indicted on the charges of grand larceny, taking the identity of another and two counts of uttering.

On Sept. 25, State Police troopers responded to Freedom Bank in Belington in reference to a fraud complaint. The bank staff advised the officers that an unknown male subject had fraudulently obtained $7,000 while using the identity of a Barbour County man, the criminal complaint states. The subject, later identified as Thompson, presented a Pennsylvania driver’s license that had his own photo, but also the name of the victim. Thompson allegedly knew the victim’s social security number and wife’s name as well.

Thompson allegedly signed an electronic signature as the victim to obtain $3,500 and then passed a fraudulent paper check, which he signed with the victim’s name, also for $3,500, the complaint states. A total of $7,000 was obtained from the bank.

While officers were on the scene, bank staff called the Freedom Bank in Elkins to inform them of the incident, the complaint states. During the call, the Freedom Bank in Elkins advised that Thompson was currently in their bank and attempting to “fraudulently obtain additional funds.” Thompson was detained by State Police troopers in Elkins.

Jacob Eugene Bowles was indicted on two counts of domestic battery-third offense.

Emily Brook Collins was indicted on the charges of grand larceny and failure to appear.

Russell Allen Grow was indicted on the charge of failure to appear.

Randell Vincent Patterson was indicted on three counts of failure to register as a sex offender.

Arraignments will be March 4, beginning at 9 a.m. in the Barbour County Courtroom. All defendants are presumed innocent until and unless they are proven guilty.
