Buckhannon man faces domestic, firearm charges

BUCKHANNON — An Upshur County man faces felony charges after allegedly striking a woman and illegally possessing two firearms.

Scott Alan Davis, 32, is charged with one count of prohibited person carrying a concealed firearm, a felony. He is also charged with one count of second offense domestic assault or domestic battery and one count of prohibited person possessing a firearm, both misdemeanors. Davis is currently being held at the Tygart Valley Regional Jail on a $21,000 cash-only bond.

According to the criminal complaint filed by Sgt. T.R. Collins with the Upshur County Sheriff’s Office, on March 2, Collins was advised of a domestic situation that had occurred on Bryan Foster Road in Buckhannon.

Upon arrival at the entrance of Bryan Foster Road, Collins spoke with the alleged victim who stated that Davis had allegedly hit her, the complaint states. The alleged victim reportedly stated that she had learned that Davis had multiple social media accounts and when she confronted Davis, he “became upset.” The alleged victim advised Collins that, while she was laying on the couch in the residence, Davis allegedly picked up a glass dog treat container and threw it on the floor, causing the container to break. Davis then told the alleged victim to “be careful” when she got up.

The alleged victim also told Collins that, when she was at the computer, looking at Davis’ social media accounts, Davis walked in and allegedly struck her on the “left cheek/eye area,” the complaint states. She stated that she became scared and left the residence, locking herself in a vehicle and calling 911. Collins writes that he observed a red mark on the alleged victim’s cheek.

Collins then went to the residence to speak with Davis, but did not see his vehicle in the driveway, the complaint states. The alleged victim allowed Collins to search the residence for Davis, but he was not at the scene. Upon searching the residence, Collins reportedly found a rifle sitting by the front door.

The alleged victim told Collins that she was fearful that Davis would hurt himself, the complaint states. When Collins asked if Davis would have any weapons on him, the alleged victim stated that her pistol had been left in his vehicle.

After Collins returned to the Upshur County Sheriff’s Office, the alleged victim reached out and stated that Davis had called her “multiple times,” the complaint states. During one of these calls, Davis reportedly threatened the alleged victim, stating that he could get her in trouble by using her pistol to murder someone “so she could get charged for it.”

According to the complaint, Davis has a prior domestic battery charge from 2021 in Lee County, Florida.

A preliminary hearing for Davis has been scheduled for March 10 at the Upshur County Magistrate Court.
