Upshur man charged after police pursuit

BUCKHANNON — An Upshur County man faces charges after allegedly fleeing from police through the streets of Buckhannon.

Lincoln Marshall Norman, 32, is charged with one count of fleeing with reckless indifference, a felony; and one count of obstructing law-enforcement, probation, parole, court security or corrections officer with threats of harm, a misdemeanor. Norman is currently being held at the Tygart Valley Regional Jail on a $15,000 cash-only bond.

According to the criminal complaint filed by Patrolman C. Spotloe with the Buckhannon City Police Department, on March 20, while on patrol, Spotloe observed a vehicle run a stop sign at the intersection of First Street and Cleveland Avenue in Buckhannon.

Once turned around, Spotloe attempted to get behind the vehicle to perform a traffic stop, the complaint states. Yet before Spotloe could get his cruiser back into drive, the suspect’s vehicle began to “rapidly accelerate” towards Elias Street.

Spotloe then activated his emergency lights on the bridge of Cleveland Avenue, according to the complaint. During the pursuit, Spotloe could not make out the style of the vehicle due to the dust it was throwing up while speeding on Elias Street.

Spotloe then observed the vehicle turn left into an alleyway at the end of Elias Street, where a family had been standing, the complaint states. The family was holding a child and pointed towards the alleyway where the vehicle had turned down. Spotloe attempted to follow the vehicle and found it sitting on Cooper Street. Spotloe also observed a male subject, later identified as Norman, walking outside of the vehicle.

Spotloe then gave a “loud and clear” verbal order for Norman to get back into the vehicle, which Normal allegedly “did not listen” to, the complaint states. Norman was placed in mechanical hand restraints and secured into the back of Spotloe’s cruiser.

The father of the family near the alleyway approached the scene and spoke with Spotloe, the complaint states. When asked what he had witnessed, the father allegedly stated that the vehicle “was going at least 50 to 60 mph.” The father told Spotloe he had been “kind of worried for a second” because he honestly didn’t know how Norman made the turn into the alleyway.

While at the Buckhannon Police Department for processing, Norman allegedly became “uncooperative,” the complaint states. Norman reportedly refused to give Spotloe his leg so Spotloe could unshackle him. Norman also allegedly stated that he did not know his Social Security Number or his age.

A preliminary hearing for Norman has been scheduled for March 26 in Upshur County Magistrate Court.
