Upshur man charged with felony escape

BUCKHANNON — An Upshur County man is facing a felony charge after allegedly failing to return to home confinement for two months.

Henry Andrew Cabic, 34, is charged with one count of escape or attempted escape, a felony. He is currently being held at the Tygart Valley Regional Jail on a $45,000 cash-only bond.

According to the criminal complaint filed by Sgt. Tyler A. Gordon with the Upshur County Sheriff’s Office, on Nov. 19, Cabic was admitted to bail, with home confinement as a stipulation. He was facing felony charges for allegedly forging, uttering or attempting to employ as true, a forged writing to the prejudice of another and for possession of counterfeit or unauthorized access device with intent to defraud.

On Dec. 10, Cabic was permitted to attend drug rehabilitation, the complaint states. Cabic was still under the supervision of the Upshur County Home Confinement program at this time and was reportedly supposed to return to GPS monitoring once he left or completed the rehabilitation program.

Cabic allegedly left the rehabilitation facility on Dec. 15, the complaint states. He reportedly had made no contact with either of Home Confinement Program officers with the Upshur County Sheriff’s Office as of Feb. 27. 

According to jail records, Cabic was booked on Feb. 27. He is also facing a misdemeanor shoplifting charge filed on Feb. 26.

A preliminary hearing for Cabic has been scheduled for March 9 at the Upshur County Magistrate Court.
