Upshur man faces multiple charges
BUCKHANNON — An Upshur County is facing multiple charges after being pulled over for a traffic stop.
John Michael Spaur was charged with DUI-third offense and possession of marijuana.
According to the criminal complaint, prepared by Sgt. T.R. Collins of the Upshur County Sheriff’s Office, on March 6, Collins observed a 2019 Jeep Grand Cherokee on Route 20 South with an “unreadable” license plate and an expired registration.
Collins initiated a traffic stop and spoke to the driver, Spaur, and “inquired about his medical use of marijuana,” the complaint states. Spaur allegedly said that he “eats” medical marijuana and had last used it the evening before.
The office asked Spaur to step out of the vehicle and perform a field sobriety test, which showed “multiple signs of impairment,” according to the complaint, including “eyelid tremors, raises arms for balance, incorrect steps, uses arms for balance, puts foot down,” and Spaur allegedly had the “odor of marijuana emitting from his breath.”
Spaur consented to a search of his vehicle, the complaint states, and Collins found “a burnt ‘roach’ that still had green leafy substance near the bottom.” It was found “under the driver’s side seat.”
The complaint states that Spaur has two prior convictions for driving under the influence, and “is currently using the Test and Lock System in his vehicle.”
Spaur refused a secondary test of his blood, so Collins obtained a search warrant, which was executed on Spaur at St. Joseph’s Hospital, according to the complaint. He was then transported to Tygart Valley Region Jail.
