Grand jury to hear failure to register case

ELKINS — Probable cause was found in the case of a Randolph County man accused of not living where he claimed to be on his sex offender registry.

Billy Lee Isenhart, 41, is charged with two counts of failure to register as a sex offender. He is currently being held at the Tygart Valley Regional Jail on a $50,000 10% cash bond.

On May 11, Isenhart appeared in Randolph County Magistrate Court for a preliminary hearing with attorney James Hawkins. During the hearing, Randolph County Magistrate Michael Dyer found probable cause against Isenhart, moving his case to be considered by the Randolph County Grand Jury.

According to the criminal complaint filed by Corporal S.P. Miller with the West Virginia State Police, on Feb. 26, Miller received a call from an ex-girlfriend of Isenhart, who is a registered sex offender in Randolph County. She gave a written statement to Miller advising that, Jan. 20, Miller had not been living with her at her Pleasant Avenue residence in Elkins.

The ex-girlfriend told Miller that Isenhart had allegedly been sleeping in his car with another woman and at other places where people would let them stay, the complaint states. She advised that Isenhart was frequently at a residence next to Dawson’s Towing.

Miller pulled Isenhart’s last sex offender registry form, which was dated Feb. 20, the complaint states. Isenhart allegedly advised Senior Trooper A.P. Petrella that he had been physically living between his ex’s Pleasant Avenue residence and a residence on “Gilmer Street” in Elkins. Miller confirmed with Randolph County 911 that there was no “Gilmer Street” in Elkins.

On April 1, Miller traveled to a residence on Gilmore Street in Elkins and met with a witness who said he resided in the home and knew Isenhart, the complaint states. The witness reportedly said that Isenhart did not live at the residence. He told Miller that Isenhart had only stayed at the residence approximately three times in the last month and a half and that, as far as he knew, Isenhart was living out of a car with his new girlfriend.

Miller writes that Isenhart is not living at either location listed on his sex offender registry and is therefore in violation of the registry. Miller also confirmed two prior convictions for failing to register as a sex offender in Randolph County with conviction dates of 2014 and 2019.
