Upshur man faces assault charge
BUCKHANNON — An Upshur County man faces a felony assault charge after allegedly knocking another man out at the Kanawha (K) Lounge on Sunday.
Jaryn Randall Moore, 25, is charged with one count of unlawful assault, a felony. Moore was being held at the Tygart Valley Regional Jail on a $10,000 cash-bond that has since been posted.
According to the criminal complaint filed by Patrolman C. Spotloe with the Buckhannon City Police Department, on May 17, at approximately 3:56 a.m., Spotloe was dispatched to the K Lounge on 18 South Kanawha Street in Buckhannon for a reported physical altercation where the suspect, identified as Moore, had already left the scene.
The Upshur County Communication Center informed Spotloe that the alleged victim was unconscious at the K Lounge and was bleeding from his mouth, the complaint states. The alleged victim also “could not follow commands or answer questions and have very minimal speaking.” The person who called 911 said that alleged victim to be semi-conscious, but highly disoriented. The alleged victim also appeared to have swelling on the left side of his face and complained of “severe pain” to his head. EMS arrived shortly after to provide medical treatment.
At 3:39 a.m., Spotloe was then dispatched to AutoZone Auto Parts on South Kanawha Street in reference to the alleged victim, the complaint states. The alleged victim stated that he did not remember what happened, but reportedly said that Moore had called his girlfriend a derogatory term and when he said something back to Moore, the alleged victim “got sucker punched.” The alleged victim had no recollection of where this happened in the K Lounge.
Spotloe observed the alleged victim to have “very dilated” eyes and the swelling getting bigger on the left side of his face, the complaint states. There was also dry blood on the bottom of his lip. Spotloe writes that this was all documented with photographs.
A bartender, who Spotloe called “credible, independent and sober” witness, stated that Moore and the alleged victim caught each other in the hallway of the exit and entrance to the bar, the complaint states. She said that Moore called the alleged victim’s girlfriend a bderogatory termh, then she heard yelling from the alleged victim before hearing a “thud.” The bartender told Spotloe that, “He (Moore) knocked the (alleged victim) flat on his a**.”
“While acting in the heat of passion,” the alleged victim tried to walk away from Moore, but Moore reportedly grabbed him and pulled him back into the hallway where he delivered a “single, forceful closed fist strike directly to the facial region,” the complaint states. The hit caused the alleged victim to “instantly lose consciousness” and fall backwards onto the floor. While bystanders went to help the alleged victim, Moore reportedly turned and quickly walked away from the scene, “fleeing the area.”
