Packages leads to felony charges
ELKINS — A Randolph County woman faces felony charges after allegedly ordering illegal substances, including a pound of marijuana, to sell in a local store.
Brandi Nicole Harris, 43, is charged with two counts of possession with intent to deliver a controlled substance (marijuana), a felony. Harris was being held at the Tygart Valley Regional Jail on a $5,000 cash-only bond that has since been posted.
According to the criminal complaint, filed by Sergeant J.M. Tallman with the West Virginia State Police, on March 27, Corporal J.O. Hensley and Trooper First Class J.A. Peteete, both members of the State Police K9 Unit, conducted parcel interdiction at a local common carrier facility in Randolph County. During their interdiction, Hensley observed a parcel packed “suspiciously with excessive tape.” Hensley placed the parcel with similar packages in size and shape and then deployed K9 Bary. Bary gave a positive alert to the parcel in question. The package was addressed to the “Twisted Shack” in Elkins.
Hensley obtained a search warrant for the parcel and discovered a vacuum sealed package containing approximately one pound of suspected marijuana and 50 illegal THC vape cartridges containing 88.84% THC, the complaint states. The items were seized as evidence.
On April 2, Peteete conducted another parcel interdiction at a local common carrier facility in Randolph County, the complaint states. During interdiction, Petette also observed a parcel packed “suspiciously with excessive tape.” Petette also placed the parcel with similar packages in size and shape and then deployed K9 Sebes. Sebes gave a positive alert to the parcel in question. The package was addressed to the “Twisted Smoke” in Elkins.
Petette obtained a search warrant for the parcel and discovered five metal tins containing five pre-rolled suspected marijuana joints each for a total of 25 joints, the complaint states. The metal tins displayed an illegal amount of THC. The items were seized as evidence.
On April 7, members of the Mountain Region Drug and Violent Crime Task Force obtained a search warrant for the Twisted Smoke Shack at 95 Ferree Road in Elkins, the complaint states. The Task Force, Hensley, Peteete executed the warrant with assistance from the West Virginia Department of Agriculture, who were able to identify a “large number” of illegal products throughout the store. The items were seized.
During the search, Harris was not located at the store, the complaint states. Tallman spoke with an employee and requested Harris come to the store, to which the employee contacted Harris, who agreed and arrived at the store. Harris agreed to talk to Tallman, who read Harris her Miranda Rights.
During their conversation, Harris allegedly denied attempting to order and sell illegal products, the complaint states. When Tallman asked about a package at the back of the store that was heavily wrapped in tape, Harris reportedly stated that the package was delivered to the store, but she did not order it. Harris said she told an employee not to open it and that she would send it back; however, a Task Force officer reportedly noticed that the package was already open. The package had the same shipping information as the one Hensley found on March 27.
Tallman asked Harris if she had messaged her employee about the package with her phone, to which Harris said she did, the complaint states. Harris consented to Tallman looking through the phone, giving him the password to the device. Tallman looked through the phone with Harris and found messages between Harris and an employee that worked at the store’s Belington location. The text allegedly said that Harris had two package orders that “were taken.”
According to the complaint, Harris pulled up her UPS tracking information and Tallman allegedly observed information for several packages, including for both of the seized packages from March 27 and April 2.
