ELKINS -- A Randolph County man faces a felony charge after allegedly retaliating against police while being detained for a stabbing.
Dashaun Xavier Moyers, 22, is charged with one count of retaliation against public official, a felony. He is currently being held at the Tygart Valley Regional Jail on a $25,000 cash-only bond, set by Randolph County Magistrate Benjamin Shepler.
According to the criminal complaint, filed by Patrolman First Class D.T. Sayer with the Elkins Police Department, on July 24, Sayer and Patrolman P.S. Marsh received a call for service from Randolph County Emergency 911 in reference to an individual that had been stabbed and was en route to Davis Medical Center.
Officers arrived at the hospital and made contact with the alleged stabbing victim, who reportedly said he had been stabbed multiple times by an individual identified as “Xavier,” the complaint states. He also told police that the stabbing happened in an abandoned building behind the hospital, and he believed he was stabbed with a knife. Officers observed wounds in multiple places on the alleged victim consistent with a stabbing.
The two officers then left the hospital and went to the abandoned building, the complaint states. There they made contact with a male individual who stated that he had entered the building to look for another person who was allegedly present during the stabbing. The officers proceeded to clear the building with negative contact with anyone inside, but as they exited, they were informed that the suspect had just fled the scene. As officers patrolled the area, Sayer made contact with the suspect, identified as Moyers.
As Sayer approached Moyers, he gave clear commands that Moyers show his hands, and to face away from Sayer, the complaint states. While Sayer detained Moyers, Moyers allegedly became “aggressive” towards the officers and was given clear commands to stop. Moyers reportedly proceeded to tense up and turn towards officers “in an aggressive manner.” Moyers then allegedly lunged towards Marsh as Sayer attempted to gain compliance and assist him to the ground. During this, Moyers reportedly continued to fight with the officers.
Sayer struck Moyers multiple times as Moyers allegedly continued to resist officers, the complaint states. Once “compliance was gained,” Sayer and Marsh escorted Moyers to the patrol vehicle where Moyers reportedly continued to resist. Once inside, Moyers allegedly failed to identify himself and remained aggressive toward the officers. Due to recent interactions with Moyers, Sayer was able to identify him.
While being transported to Elkins City Hall for processing, Moyers allegedly proceeded to scream profanities at Sayer, the complaint states. Moyers reportedly stated multiple times that he would cause “significant bodily harm” to Sayer. He allegedly stated “…you stuck up piece of s**t, I’ll kill you,” and “Whenever I’m innocent, I’m going to hurt you so badly.”
