Pellet gun incident leads to felony charge

BUCKHANNON - An Upshur County man has been charged with a felony after allegedly wounding a pedestrian by shooting him in the back with a BB/pellet gun while passing by in a vehicle.

Isaac Wayne Robinson was charged with malicious assault, a felony.

According to the criminal complaint, prepared by Patrolman Dylan Ray Major of the Buckhannon Police Department, on June 28, the officer responded to the area near Number One Auto in reference to an alleged "pellet/BB gun shooting."

The alleged victim told Major that he and his girlfriend were walking home from Sheetz when a car passed them and someone "shot him in the back," the complaint states. Major wrote that the bb/pellet went through the alleged victim’s shirt and into his "mid/lower back ... breaking the skin, causing a hole with blood running down his back." The alleged victim was then transported by EMS to St. Joseph’s Hospital for treatment.

Major wrote that he was able to "locate three possible suspects from this incident," including Robinson, according to the complaint. All three were called and asked to come to the Police Department for questioning. When questioning Robinson on July 5, Robinson allegedly gave "a full confession of the incident and stated that he was the one who shot" the alleged victim.

Major writes that he asked Robinson if he was involved in any other shootings the night of June 28, and he said yes, the complaint states. Major asked how many shootings, and Robinson allegedly said "around five, but no exact number."

Robinson also allegedly told police that he "shot at McDonald’s as well" that night. When Major asked why he did the shootings, Robinson allegedly said, "I thought it would be funny."

Major also wrote in the complaint that, days after the incident, he "followed up" with the alleged victim, who said "the pellet/BB still has not been removed from his back because medical professionals can not find a clear enough picture on where to cut it."
