Second B&E charge headed to grand jury
Slayton
ELKINS — The Grand Jury will hear another case against a Randolph County man accused of breaking in and stealing items from a local hotel in April, after he waived his right to a second preliminary hearing.
Joshua Richard Slayton, 32, is charged with one count of burglary and entry of dwelling or outbuilding, a felony. He is currently being held at the Tygart Valley Regional Jail on a $5,000 cash-only bond for this charge.
Slayton recently appeared in Randolph County Magistrate Court and, according to magistrate court records, waived his right to a preliminary hearing. His case will now be brought before the Randolph County Grand Jury for consideration. Slayton was represented in court by attorney Gregory Tingler. Magistrate Benjamin Shepler presided over the hearing.
Slayton has also been charged with one count of breaking and entering, a felony. For that charge, he is being held on a $10,000 cash-only bond. Slayton waived his right to a preliminary hearing for the breaking and entering charge on June 23, moving that case over as well to the Grand Jury. Randolph County Magistrate Michael Dyer presided over that hearing.
According to the criminal complaint, filed by Trooper H.J. Bonetti with the Elkins Detachment of the West Virginia State Police, on April 12, Bonetti was dispatched to the Iron Road Lodge on the Beverly Pike for a breaking and entering no longer in process.
Upon arrival, Bonetti made contact with a witness, the complaint states. The witness stated that someone had entered the Iron Road Lodge and had taken items, including a television. Bonetti observed a window screen had been cut. Bonetti later reportedly received an anonymous tip regarding Slayton arriving at a residence earlier and appearing “sweaty.”
On April 17, Bonetti obtained the video surveillance footage, along with a list of stolen items, from the Iron Road Lodge, the complaint states. Bonetti reportedly observed Slayton on the video surveillance footage.
