JUNIOR -- A woman is facing an assault charge after allegedly striking a male in the head with an oxygen tank in Barbour County.
Lena Ann Ross, 41, of Middle River, Maryland, is charged with one count of malicious or unlawful assault, a felony. She is currently being held at the Tygart Valley Regional Jail on a $15,000 surety/cash bond.
According to the criminal complaint, filed by Trooper R.S. Musgrave with the West Virginia State Police Philippi Detachment, on Wednesday, Musgrave was dispatched to a residence on Swick Street in Junior regarding multiple individuals involved in an altercation.
Upon arrival, Musgrave made contact with witnesses and emergency medical personnel, the complaint states. Witnesses reportedly told Musgrave that Ross had struck a male individual in the head with an oxygen tank.
As a result of being struck by the tank, the male individual suffered a seizure and was transported by EMS to Davis Medical Center in Elkins for treatment, according to the complaint.
Musgrave was told that Ross had fled the scene and was traveling toward the Beverly area of Randolph County. Musgrave contacted Randolph County law enforcement officers and informed them of what happened, police said.
Ross was located by Randolph County law enforcement officers and was detained at the Walmart in Elkins, the complaint states. After being advised of her Miranda Rights, Ross allegedly “knowingly and voluntarily” stated that she did, in fact, strike the male in the head with the oxygen tank. Ross was then taken into custody.
A preliminary hearing for Ross has been scheduled for Sept. 16 in Barbour County Magistrate Court.
