Voluntary manslaughter case among Barbour indictments

PHILIPPI — A Barbour County man who allegedly struck and killed a teenager with his vehicle was one of 24 indictments handed down Tuesday by a Barbour County grand jury.

Junior Dale Collins, 36, of Philippi, was indicted on one felony count of voluntary manslaughter, one felony count of leaving the scene of a crash resulting in death and one misdemeanor count of negligent homicide.

According to a criminal complaint filed in Barbour County Magistrate Court, at approximately 10:13 p.m. Oct. 7 along East Spall Lick Road, based on testimony from several witnesses, Collins “willfully struck” the victim with his vehicle. The collision reportedly took place while the victim was standing in a ditch line along the road.

Collins then allegedly fled the scene, and the victim died from injuries sustained in the collision.

Other indictments handed down Tuesday include:

• Jacob E. Ebersole, 30, of Philippi, was indicted on five counts of child concealment and one felony count of conspiracy.

• Jessica L. Colburn, 29, of Philippi, was indicted on five counts of child concealment and one felony count of conspiracy.

• Andrew D. Wells, 39, of Bridgeport, was indicted on one felony count of sexual assault in the first degree, one felony count of use of obscene matter with the intent to seduce a minor, one felony count of sexual abuse in the first degree and three felony counts of sexual abuse by parent, guardian or custodian.

• Bradford Smith, 80, of Moatsville, was indicted on one felony count of sexual assault in the third degree, one felony count of sexual abuse in the first degree and two felony counts of sexual abuse by parent, guardian or custodian.

• Shane A. Grow, 36, of Grafton, was indicted on one felony count of fleeing in a vehicle, one felony count of child neglect creating risk of injury, one felony count of domestic battery, third offense, one misdemeanor count of battery on a law enforcement officer, one count of destruction of property and one misdemeanor count of assault.

• Wesley A. Shifflett, 37, of Belington, was indicted on two felony counts of child neglect creating in risk of injury.

• Anthony M. Shuttlesworth, 24, of Philippi, was indicted on one felony count of escape and one count of destruction of property.

• Renee R. Jones, 38, of Philippi, was indicted on one felony count of escape.

• Madison D. Baisi, 22, of Philippi, was indicted on one felony count of escape.

• Kenneth H. Knight Jr., 33, of Belington, was indicted on one felony count of escape.

• Angela N. Coontz, 45, of Philippi, was indicted on two felony counts of operate or attempt to operate a clandestine drug lab, one felony count of conspiracy, one felony count of possession of a controlled substance with intent to deliver and one misdemeanor count of possession of a controlled substance.

• Cody A. Phillips, 34, of Belington, was indicted on one felony count of operate or attempt to operate a clandestine drug lab and one felony count of possession of substances to be used as precursor to manufacture of methamphetamine or another controlled substance.

• Christopher G. Queen, 40, of Philippi, was indicted on two felony counts of operate or attempt to operate a clandestine drug lab and one felony count of conspiracy.

• Joseph L. Shelton III, 21, of Marlboro, Maryland, was indicted on one felony count of delivery of a controlled substance and one felony count of possession of a controlled substance with the intent to deliver.

• Dearmon N. Green Jr., 20, of Frankfort, Kentucky, was indicted on two felony counts of possession of a controlled substance with the intent to deliver.

• Brian E. Kennedy, 39, of Grafton, was indicted on one felony count of prohibited person in possession of a firearm, one felony count of prohibited person in possession of a concealed firearm and two misdemeanor counts of possession of a controlled substance.

• April M. Thomas, 28, of Belington, was indicted on one felony count of burglary, one felony count of grand larceny and one count of providing false information to an officer.

• Ronald M. Gilmore, 36, of Mill Creek, was indicted on one felony count of burglary, two misdemeanor counts of battery and one misdemeanor count of petit larceny.

• Gary C. Clark, 41, of Belington, was indicted on one felony count of grand larceny and one count of transferring stolen goods.

• Kristin M. Frey, 22, of Belington, was indicted on one count of receiving stolen goods and one count of transferring stolen goods.

• Charles D. George Jr., 45, of Belington, was indicted on two felony counts of failure to register or provide notice of change of sex offender registry information.

• Desire R. Wilkie Jr., 25, of Philippi, was indicted on one felony count of driving while license was revoked for driving under the influence of alcohol, third offense.

• Evan L. Sparks, 43, of Belington, was indicted on one felony count of shoplifting, third or subsequent offense.

The cases were presented by Prosecutor Thomas B. Hoxie and Assistant Prosecutor Roger D. Curry. Circuit Court Judge Alan D. Moats presided.

Arraignment hearings will begin at 9 a.m. on March 9 at the Barbour County Courthouse.

An indictment is merely an accusation. All defendants are presumed innocent until and unless they are proven guilty.
