Elkins man facing felony charge

ELKINS — An Elkins man is facing a felony sexual assault charge after allegedly impregnating an alleged victim.

Kyle Brent Hoyman, 29, is charged with sexual assault in the third degree. His bond was set for $75,000 cash only by Randolph County Magistrate Judge Mike Dyer.

According to the criminal complaint filed by Sergeant K.A. Corley of the West Virginia State Police, the alleged victim, now 19 years old, advised the officer that she was sexually assaulted by the 24-year-old Hoyman at age 14, resulting in a pregnancy.

The report states that documents were obtained during Corley’s investigation that indicated the results of DNA testing — including a DNA test report, the birth certificate of the alleged victim’s daughter and notice of filing of paternity test — resulting that Hoyman was the father of the child.

If convicted, Hoyman could be facing one to five years in prison or be fined up to $10,000 in addition to spending one to five years in prison.
