ELKINS — A Randolph County man is behind bars after he allegedly refused to leave a structure that was not his.
Marty Ray Price, 40, has been charged with trespassing and obstructing after an incident that took place on Wednesday. Price is currently lodged in the Tygart Valley Regional Jail on a $200 cash-only bond.
According to a criminal report released by Sheriff Rob Elbon, deputies responded to the area of Kimble Lane in regard to a reported breaking and entering in progress. In a field behind the Randolph County Children’s Advocacy Center, deputies located a red structure where the crime was reportedly taking place.
The report states that deputies made contact with Price, who was inside the structure. The defendant told officers that he did not know who owned the property and said no one did. Price then allegedly became very confrontational and argumentative and was placed in hand restraints.
Deputies were able to locate the owner of the property, who said Price did not have permission to be there and he wanted him to leave, the report states. The defendant was advised that he was being trespassed from the property and was instructed to leave. Price told officers that he was not going to leave and refused to do so multiple times.
According to the report, Price continued to be uncooperative, and was then arrested and transported to TVRJ to await arraignment.
