Randolph man sentenced on drug charges

ELKINS — A Randolph County man arrested on drug charges after the Mountain Region Drug and Violent Crime Task Force executed an arrest warrant in 2024 has been sentenced on three counts in Randolph County Circuit Court.

Timothy Lee Summerfield, 40, was sentenced by Randolph County Circuit Court Judge Jaymie Godwin Wilfong to one to 15 years in prison, suspended in favor of five years of supervised probation, and a $5,000 fine for one count of possession with intent to deliver a controlled substance-methamphetamine, a felony. 

Summerfield was also sentenced to six months in prison, suspended in favor of five years of supervised probation, and a $2,500 fine for one count of knowingly keeping or maintaining a dwelling, building or other structure or place for the purpose of using or selling controlled substances, a misdemeanor. Both supervised probations will run concurrently, Wilfong said.

He was also sentenced to one to five years in prison, with credit for time served, and a $2,500 fine for one count of conspiracy, a felony. This sentence will be served before his sentenced supervised probation.

Wilfong also stated that she wanted Summerfield to be interviewed for both the Adult Drug Court and North Central Community Corrections’ programs. If accepted to either or both programs, Summerfield will be required to successfully complete the program or programs as part of his probation.

“My hope is that you’ve done enough time in jail, you want to change your life,” Wilfong said to Summerfield after sentencing him. “I know you’re on the MAP program, so that’s great. You’re clean at this time.

“Historically, we know when you get out of jail… you’re going to need a lot of positive services around you to help you. I don’t want to just turn you out and then you relapse and you violated your… probation and you end up in jail for one to five years. Because that’s what would happen.”

Summerfield was initially indicted on five counts of possession with intent to deliver a controlled substance, a felony; one count of conspiracy, a felony; and one count of knowingly, keeping or maintaining a dwelling, building, or other structure or place for the purpose of using or selling controlled substances, a misdemeanor. He accepted a plea agreement on May 1.

According to the criminal complaint, prepared by Sgt. Joshua Tallman of the West Virginia State Police, on July 29, 2024, members of the Task Force executed the arrest warrant for Timothy Summerfield for possession with intent to deliver a controlled substance. “Mr. Summerfield previously admitted to selling controlled substances,” the complaint states.

During the arrest, officers “observed drug paraphernalia in plain view… (and) discovered suspected controlled substances, baggies, digital scales, suspected cutting agents … and U.S. currency,” according to the complaint.
