Man enters plea to drug charge
ELKINS — A Randolph County man has entered a plea agreement in Randolph County Circuit Court to lower the amount of charges he was facing for delivery of a controlled substance.
Robert William Maxwell, 34, pleaded guilty to one count of delivery of a controlled substance, a felony. Maxwell was initially indicted by a Randolph County Grand Jury on three counts of manufacturing or possessing with the intent to deliver Schedule I or II narcotic or meth, a felony, in October 2024.
Maxwell is currently being held at the Tygart Valley Regional Jail. He could be sentenced to not less than one year, no more than 15 years in prison or be fined not more than $25,000, or be both fined and imprisoned.
Representing Maxwell was attorney Steve Nanners, who stated that he believed this agreement was in Maxwell’s best interest.
When asked by Circuit Judge David Wilmoth what he did that made him guilty of delivery of a controlled substance, Maxwell simply stated that he gave someone drugs for some money.
Assistant Randolph County Prosecutor Richard Shryock informed the court of the factual basis for the case, stating that, on Nov. 3, 2023, a confidential informant working for the Mountain Region Drug and Violent Crimes Task Force contacted the Task Force and said they had spoken to Maxwell online. The informant had arranged to purchase a half gram of methamphetamine from Maxwell for $50.
Shryock explained that the Task Force and the informant traveled to the location, a parking lot on Harrison Avenue in Elkins, where the informant was supposed to meet with Maxwell. Through video and audio recording, the Task Force was able to witness Maxwell deliver approximately a half gram of methamphetamine to the informant, who gave Maxwell $50. The money was provided to the informant by the Task Force. The informant then returned to the Task Force officers and gave them the methamphetamine.
When asked by Wilmoth if what Shryock had said was factual, Maxwell said yes. Maxwell then pleaded guilty to one charge of delivery of a controlled substance.
Maxwell is set to be sentenced on Dec. 3.
