Probable cause found in assault case

ELKINS — Probable cause was found in Randolph County Magistrate Court Thursday afternoon in the case of a local man charged with sexual assault in the first degree.

Rocky Lee Wood, 35, facing a felony count of first-degree sexual assault, appeared in Magistrate Court for a preliminary hearing on Thursday.

During the hearing, Magistrate Benjamin Shepler ruled that probable cause was found for the case to be bound over to Randolph County Circuit Court.

Wood is accused of having inappropriate sexual contact with a child. 

According to a Child Protective Service (CPS) worker, who was called as a witness by Assistant Randolph County Prosecutor Leckta Poling Thursday, CPS had been informed in May 2023 that Wood, who was placed on the sex offender registry after a previous charge, had illicit contact for a period of time with a minor child.

The worker stated to the court that the child, who at the time was 6 years old, possibly suffered injury from the assault.

Wood is currently being held at Tygart Valley Regional Jail on a $100,000 cash-only bond. He is being represented by Philip Isner of Isner Law.
