Man facing new sex assault charges
BUCKHANNON — A Buckhannon man who was arrested earlier this month for allegedly sexually assaulting an 8-year-old is facing more charges related to two different juveniles.
Kenneth Thompson, 36, has been arrested for two counts of sexual assault in the third degree, both felonies, according to information in the Upshur County Magistrate Clerk’s office. Thompson was previously arrested for sexual assault in the first degree, a felony, as reported in the Jan. 8 edition of The Inter-Mountain.
Deputy Seth Cutright with the Upshur County Sheriff’s Department is the investigating officer in all three counts.
In the two newest counts, Cutright interviewed Thompson who alleged that he had oral intercourse with a 14-year-old approximately 45 times and with a 13-year-old approximately 10 times in his Valley Green apartment over a two-year period.
Magistrate Mike Coffman set bond at $100,000 for the two felonies. Thompson had already been arraigned on a $125,000 bond for the other felony.
Sexual assault in the first degree is defined under state code 61-8B-3(a)(2) as when a person 14 years or more engages in sexual intercourse or sexual intrusion with another person who is younger than 12 years old and is not married to that person. State code 61-8B-5(a)(2) defines sexual assault in the third degree as when a person being 16 years old or more engages in sexual intercourse or sexual intrusion with another person who is less than 16 years old and who is at least four years younger than the defendant and is not married to the defendant.
If convicted of the two newest counts, Thompson faces one to five years in prison and/or a fine of not more than $5,000 on each count.
In a separate case, Trooper J.S. Tonkin with the Buckhannon detachment of the West Virginia State Police arrested Bobby E. Conley, 50, of Remington, Indiana, for being a fugitive from justice, according to the file in the Upshur County Circuit Clerk’s office. Conley was wanted on a probation violation, according to the warrant from Jasper County, Indiana. The case was transferred to Upshur County Circuit Court for extradition proceedings.
