Elkins man arrested after allegedly fleeing officers

ELKINS — An Elkins man is facing drug charges after allegedly attempting to flee from officers both in a vehicle and on foot.

Billy Lee Isenhart, 34, is charged with possession with intent to deliver a controlled substance and fleeing with reckless indifference. Randolph County Magistrate Ben Shepler set bond at $50,000 cash only.

According to the criminal complaint, prepared by Senior Patrolman D.T. Sayre of the Elkins Police Department, he noticed a gray Jeep with what appeared to be an expired registration on Aug. 5. Sayre attempted to follow the vehicle, which made “an immediate right turn on Henry Avenue and travel(ed) towards the four-way intersection of Second and Henry, where it rapidly turned right as it continued past the stop sign.”

Sayre activated his vehicle’s emergency lights and siren and followed the Jeep “between the alley of Henry and Kerens, where it came to an abrupt stop” and Isenhart, who was the driver, “exited the driver side of the vehicle and began to flee on foot,” the complaint states.

Sayre pursued Isenhart “into backyards of residence and onto Second Street” and then lost sight of the suspect, according to the complaint. As Sayre began to walk back to the patrol car, “bystanders” told the officer Isenhart had run underneath a porch. As Sayre approached, he saw Isenhart was “hiding between a porch and shrubbery.”

The officer ordered Isenhart to comply but he did not, the report states. Sayre then “deployed a one-second burst of Fox O/C spray to the facial area of Isenhart.” The suspect was then placed in a patrol vehicle.

Sayre wrote that during the pursuit he “observed individuals on the roadway and nearby sidewalks that (Isenhart) put in danger by fleeing.” While searching the Jeep, officers found a digital scale covered “with a white crystalline substance consistent with methamphetamine.”

On Isenhart’s person, Senior Patrolman C.G. Boatwright found cash, multiple baggies, a baggie with a substance that appeared to be methamphetamine, and a baggie featuring an image of “the Breaking Bad character ‘Heisenberg,'” the police report states.

Isenhart is also facing two felony counts of failure to register as a sex offender.
